Counter Notification

If you believe that your content has been unjustly removed due to alleged copyright infringement on the platform, you have the option to file a counter notification in accordance with relevant legal provisions, particularly following the guidelines outlined in the Digital Millennium Copyright Act (DMCA) sections 512(g)(2) and (3).

To proceed with a counter notification on our platform, we require a formal, written communication sent via regular mail. Please note that, unless we have agreed otherwise in writing, we cannot accept this information via email. It’s essential to bear in mind that you could be held liable for damages, including legal costs and attorney fees, if you make a material misrepresentation that a product or activity does not infringe upon the copyrights of others.   5. A statement made under penalty of perjury, attesting to your good faith belief that the affected material was removed or disabled due to a mistake or misidentification of the material to be taken down.
  6. A signature to validate the document.

Upon receiving your counter notification, ‘glimpxo’ will promptly furnish the individual who submitted the original infringement notification with a copy of your counter notification. Furthermore, we will inform them that ‘glimpxo’ intends to reinstate the removed material or cease restricting access to it within 10 business days. Unless our designated agent is notified by the individual who filed the original infringement notification that they have initiated legal proceedings to restrain you from engaging in infringing activity related to the material on our platform, ‘glimpxo’ will reinstate the removed material and lift access restrictions within a period not less than 10, nor more than 14, business days following receipt of the counter notification.

Repeat Infringers

Complying with Section 512(i)(1)(A) of the DMCA, ‘glimpxo’ will, when deemed appropriate, take measures to disable and/or terminate the accounts of contributors who demonstrate a pattern of repeat copyright infringement.
